This is a translation for convenience. In case of discrepancy, the Italian version prevails.

1. Who we are

Forest Maker is a service of HawkService — Sole Proprietorship, Via del Sarago 1, 97016 Pozzallo (RG), Italy, VAT no. IT01734340886 (“we”). Contact: supporto@forestmaker.app.

By using the service you accept these terms. If you do not accept them, do not use the service.

2. What the service does

Forest Maker is a planning and estimation tool: it lets you draw plots on a satellite map, compute plant layouts from the parameters you set, consult public cadastral data, obtain economic and irrigation estimates, and export the result in various formats.

4. Plans and pricing

The free plan lets you draw, calculate and save 1 project. Premium adds full exports (ZIP with KML, CSV, GPX, GeoJSON, Shapefile, DXF and a report), unlimited projects and the estimate modules’ exports.

Premium costs €9.90 per month or €79 per year, VAT included. Prices may change: a change never affects a period already paid for and will be announced at least 30 days before renewal.

6. Right of withdrawal (consumers)

If you are a consumer you may withdraw within 14 days of subscribing, without giving a reason, by writing to supporto@forestmaker.app.

As the service is digital and immediately accessible, at purchase you are asked to consent to immediate performance: if you use Premium features during the 14 days and then withdraw, you will be charged an amount proportionate to the service already used, as provided by Article 57 of the Italian Consumer Code.

8. Your content

The projects you create remain yours. We claim no ownership and use them for no purpose other than running the service. You grant us only the technical licence needed to store, process and display them. You can export them at any time (with Premium, in the open formats listed) and obtain a copy on request.

9. Map and cadastral data

Satellite imagery, elevation data and cadastral parcels come from third parties (including Esri and the Italian Revenue Agency). They are provided “as is”: they may date from different times, contain inaccuracies or not cover the whole territory. In particular the Revenue Agency’s cadastre does not cover Trentino-Alto Adige / South Tyrol, where a provincial land register applies. Cadastral views in the service are indicative only and do not replace an official extract.

10. Availability

We work to keep the service available but do not guarantee uninterrupted, error-free operation. We may suspend it for maintenance, updates or technical reasons, keeping disruption to a minimum. We may change or retire individual features: where these are significant Premium features we will give advance notice and you may cancel with a refund of the unused portion.

11. Liability

To the extent permitted by law, we are not liable for damage arising from decisions taken on the basis of the estimates produced by the service, for loss of crop or profit, or for inaccuracies in third-party map and cadastral data. Our total liability towards you does not exceed what you paid us in the 12 months preceding the event.

Nothing in these terms excludes or limits our liability for wilful misconduct or gross negligence, for personal injury, or the mandatory rights granted to consumers by Italian and European law.

12. Closing your account

You can request account deletion in the app, under “Settings”: we complete it within 3 working days. Deletion permanently removes your projects — export them first if you need them. If you have an active subscription, cancel it or ask us to do so at the same time.

13. Changes to these terms

We may update these terms. Significant changes will be notified by email or with an in-app notice at least 15 days before they take effect. Continuing to use the service after that date means you accept them; otherwise you may cancel.

14. Governing law and disputes

Italian law applies. If you are a consumer, the court of your place of residence or domicile remains competent; otherwise the competent court is that of Ragusa, Italy.

As a consumer you may also use the European Online Dispute Resolution (ODR) platform.
